Superintendent Of Police To Know Fate November 7 Over Infringement On Fundamental Rights

OpenLife Nigeria reports that a Federal high court Judge, Honourable Justice, Daniel Osiagor,has summoned Superintendent of Police Usidamen Odion, attached to Legal Department at the office of A.I.G Force Criminal Investigation Department Alagbon Ikoyi Lagos to appear in court personally on 7th of November,2023 to answer the allegations of harassment and unprofessional conduct made against him by a Lagos Lawyer, Barrister Kola Sodiya.

Mr Sodiya complained to the court that, Superintendent Usidamen, infringed on his fundamental rights, when he visited Force CIID Alagbon to make enquiry despite the fact that his fundamental rights enforcement suit is pending before the Court for adjudication.

In a bid to save guard his right, Mr.Sodiya had filed a suit before the Court against,SP Usidamen Odion, Inspector General of Police,Deputy Inspector General of Police Force CIID,Area 10,Abuja, Assistant Inspector General of Police,Force CIID Alagbon Ikoyi, Lagos,AIG Zone 2,Onikan.

Others are, Adeleke Sunday,Sile Omoniyi and Adebayo Elabanjo Mr Sodiya while urging the court, to declare his detention on 7th of August,2023 by SP Usidamen Odion and Adeleke Sunday unlawful,is also urging the court to restrain,the police officers named as defendants and their agents from arresting, detaining,harassing and intimidating him on the instructions and petition of Sile Omoniyi and Adebayo Elabanjo.

Mr Sodiya is also claiming the sum of N500million as general damages, against Sile Omoniyi and Adebayo Elabanjo jointly and severally for instigating and using the Nigerian Police personnel to harass and molest him with respect to the issue concerning ownership of land or interest in same which is subject of litigation pending before, Honourable Justice Oluyemi of the Lagos state High court.Ikeja .

In a statement of fact deposed to and filed before a Federal high court in Lagos,Mr.Sodipo averred that by a letter of appointment dated 28th January, 2020, Adebayo Elabanjo appointed his law firm to carry out all lawful actions in respect of the recovery of his share of his late father’s 10acres of land situate and lying at Ifako-Gbagada, Lagos.

Subsequently a Retainer Agreement dated 215 May, 2020 was executed between him, Mr Elabanjo and one Mr. Afolabi Odunewu who was his Attorney.

It was mutually agreed that he will be financially responsible for all expenses to recover his share of his father’s land lying at Ifako Gbagada, Lagos and that he shall be entitled to 30% of the sum recovered from the estate’s land.

However having worked assiduously to recover Adebayo Elabanjo’s share of his father’s Estate and also consolidated the position of the Siblings,he purportedly terminated the Agreement by sending a message to him contrary to the terms of the tripartite agreement dated 7th May, 2021.

He discovered that Adebayo Elabanjo and his sister Modupe Elabanjo were taking calculated steps to ensure that he does not receive his entitlement for work done to recover and secure their father’s land for them.

They were taking calculated steps to deprive him of his 30% entitlement after expending so much time, efforts, expertise and money to secure their late father’s land on the parcel of land measuring 3520.646sq. meters.

He then filed a civil action against the duo Adebayo Elabanjo and his sister

That the land is subject of litigation in suit no: ID/8544GCMW/2022 before Honourable Justice Oluyemi of the Lagos State High Court, Ikeja Judicial Division.

Upon filing the suit, Sile Omoniyi who claimed to be Adebayo Elabanjo’s Agent began to threaten his life,he then petitioned the office of the AIG Force CIID Alagbon Ikoyi Lagos.

He also received a letter of invitation from the office of the AIG Zone 2 with respect to a petition written by Sile Omoniyi
Sile Omoniyi’s petition was assigned to SP Usidamen Odion and Adeleke Sunday for investigation.

He inform them that the matter was a subject of litigation which was currently pending before a court of competent jurisdiction and that the petitioner has been threatening his life since he filed the suit.

He went to the office of the AIG Force CIID Alagbon , finger print section on the 7th August, 2023 to sort out an issue for one of his Clients,when he was about to go out of the premises of the Force C.I.I.D he was accosted by Adeleke Sunday who informed him that the officer-in-Charge (O/C) Legal wanted to see him.

He willingly followed him to the Office of the Officer in-charge of Legal. At the Office of the O/C Legal,he was introduced to the O/C legal by Adeleke Sunday as the person to be charged to Court.

He was detained between the hours of 11am to about 4pm and was prevented from using his phone which he left in the car despite his several demands that he be allowed to call his lawyers and wife who were in the Office.

Notwithstanding the production of the letter of withdrawal of Sile Omoniyi’s
petition, the Officers of the AIG still went ahead to charge him to Court on a matter which is pending before a Court of competent jurisdiction.

All attempts made by him to convince Adeleke Sunday to allow him use his phone to call a driver that would pick up his daughter where she is doing her internship at the Nigerian Institute of International Affairs, Kofo Abayomi Street, Victoria Island, Lagos, since he was being arrested and would not be able to pick her as he usually do, proved abortive.

Mr. Sodiya avers further that he has suffered a lot of psychological and emotional trauma and has been demeaned and ridiculed in the eyes of right-thinking members of the public, professional colleagues, friends, business associates and Clients because of the activities of the defendants against him.

Adebayo Elabanjo intentionally and deliberately allowed the Sile Omoniyi to harass, intimidate and infringe on his fundamental rights despite the subsistence of Suit No: ID/8544GCM/2022 before a court of competent jurisdiction and the Order of Hon. Justice Oluyemi in the said suit.

The Respondents deliberately infringed on his fundamental right and they are still making plans to detain, harass and infringe on the fundamental rights of the Applicant notwithstanding the charge in H/27/2023 as the Sile Omoniyi is always in the office of the SP Usidamen Odion and Adebayo Sunday on regular basis.

Barrister Kola Sodiya has petitioned the office of the AIG Force CIID Alagbon against SP Usidamen Odion and Adebayo Sunday for their unprofessional conduct but the petition is yet to be investigated and is not receiving the necessary attention it deserves.
