Lagos businesswoman, Mabel Alabijah Husseini, Who Sued Estranged Husband Alleges Police Harassment

<p>Lagos businesswoman<&sol;p>&NewLine;<p>&nbsp&semi;<&sol;p>&NewLine;<p><strong><a href&equals;"https&colon;&sol;&sol;openlife&period;ng&sol;">OpenLife Nigeria<&sol;a><&sol;strong> reports that despite a court barring the police from harassing or violating her rights&comma; Mabel Alabijah Husseini&comma; a Lagos-based businesswoman&comma; has filed a fundamental rights enforcement suit against the Nigerian Police&comma; her estranged husband&comma; Mr&period; Adedeji Adesiyan and eight other respondents&period;<&sol;p>&NewLine;<p>On 8 October 2025&comma; Hon Justice A&period; O&period; Owoeye had granted an order &OpenCurlyDoubleQuote;restraining the Respondents from taking further steps in connection with this suit and maintain status quo pending the hearing and final determination of the Applicant’s Fundamental Human Rights application dated 24th July 2025&period;”<&sol;p>&NewLine;<p>The other respondents are&colon;<&sol;p>&NewLine;<p><em><strong>&CenterDot; Inspector-General of Police<&sol;strong><&sol;em><&sol;p>&NewLine;<p><em><strong>&CenterDot; Deputy Inspector-General of Police&comma; Force Criminal Investigation Department &lpar;FCID&rpar;&comma; Abuja&semi;<&sol;strong><&sol;em><&sol;p>&NewLine;<p><em><strong>&CenterDot; Assistant Inspector-General of Police&comma; FCID Annex&comma; Alagbon&semi;<&sol;strong><&sol;em><&sol;p>&NewLine;<p><em><strong>&CenterDot; Assistant Inspector-General of Police&comma; Zone 2 Command<&sol;strong><&sol;em><&sol;p>&NewLine;<p><em><strong>&CenterDot; Chief superintendent of police identified as Bolugi<&sol;strong><&sol;em><&sol;p>&NewLine;<p><em><strong>&CenterDot; Inspector Abayomi Michael&comma;<&sol;strong><&sol;em><&sol;p>&NewLine;<p><em><strong>&CenterDot; Economic and Financial Crimes Commission &lpar;EFCC&rpar;&comma;<&sol;strong><&sol;em><&sol;p>&NewLine;<p><em><strong>&CenterDot; Citadel Views Gardens and Estates Ltd&period;<&sol;strong><&sol;em><&sol;p>&NewLine;<p>In the suit filed at the Federal High Court&comma; Ikoyi&comma; Lagos with reference number FHC&sol;L&sol;CS&sol;1468&sol;25 and dated July 24&comma; 2025&comma; Ms&period; Hussain accused the respondents of unlawful arrest&comma; detention&comma; extortion and persistent harassment&period;<&sol;p>&NewLine;<p>Hussaini said she was harassed by the police over matrimonial disputes with her estranged husband&period; She therefore prayed the court to declare that the actions of the respondents violated her rights to dignity of the human person&comma; personal liberty&comma; fair hearing&comma; private and family life and freedom of movement as guaranteed under the Nigerian Constitution&period;<&sol;p>&NewLine;<p>In the suit&comma; Alabijah Hussaini detailed how she got married to Adesiyan in 2016 under native law and custom&comma; and that the marriage produced a daughter&comma; now eight years old&period;<&sol;p>&NewLine;<p>She averred that in November 2024&comma; her husband gave her &dollar;60&comma;000 to invest in real estate and to establish a trust fund for their child&period;<&sol;p>&NewLine;<p>She claimed she used the funds accordingly by purchasing a property located at E18&comma; Citadel Estate&comma; Ogombo Road&comma; Lekki&comma; Lagos&comma; in the child’s name&comma; Ayodeji Mirabel Adesiyan&period;<&sol;p>&NewLine;<p>Also&comma; she opened a trust fund for her benefit&period;<&sol;p>&NewLine;<p>Ms&period; Hussaini averred further that the relationship later turned sour after she discovered that her husband had allegedly contracted other marriages in Nigeria and the United Kingdom&period;<&sol;p>&NewLine;<p>The said husband&comma; Mr&period; Adesiyan subsequently relocated to the UK and later demanded a refund of the money&comma; despite knowing that it had already been invested for their daughter&period;<&sol;p>&NewLine;<p>Despite her explanations to the husband that the funds were no longer available&comma; having been invested for their child&comma; she began receiving threats to her life and that her husband later reported her to the police on allegations of theft&period;<&sol;p>&NewLine;<p>Hussain averred that she was arrested by police officers from Elemoro Police Station&comma; Ibeju-Lekki&period; But after stating her case&comma; they granted her bail&period;<&sol;p>&NewLine;<p>However&comma; according to court papers she filed&comma; Hussain states that the matter escalated on 7 January 2025 when officers from the FCID Annex&comma; Alagbon&comma; Ikoyi&comma; Lagos arrested her and her eight-year-old daughter at gunpoint and took them to their detention&period;<&sol;p>&NewLine;<p>Hussaini deposed that she was verbally abused&comma; humiliated&comma; and detained for several hours without being allowed to fully state her case&comma; all in the presence of her minor daughter&period;<&sol;p>&NewLine;<p>Furthermore&comma; she claimed that the officers demanded N2 million for her release but eventually compelled her to pay N500&comma;000 through a point-of-sale &lpar;POS&rpar; operator after threatening to remand her in prison&period;<&sol;p>&NewLine;<p>Following the turn of events&comma; her lawyers petitioned the Inspector-General of Police&comma; who asked that the matter be transferred to the Zone 2 Police Command and treated as a civil and matrimonial dispute&period;<&sol;p>&NewLine;<p>Even then&comma; she claimed that criminal charges were later filed against her&period; The charges were subsequently withdrawn after senior police authorities acknowledged that the dispute was civil in nature&period;<&sol;p>&NewLine;<p>Notwithstanding the above&comma; Hussaini further alleged that the police continued to harass her and interfered with the property transaction by instructing the estate developer not to release documents relating to the Lekki property purchased in her daughter’s name&period;<&sol;p>&NewLine;<p>She said the actions of the respondents caused her and her child severe emotional and psychological trauma&period;<&sol;p>&NewLine;<p>Consequently&comma; the embattled woman has asked the court for the following declarations among others&colon;<&sol;p>&NewLine;<p>&CenterDot;<em> A declaration to restrain the respondents from further arresting&comma; detaining or harassing her in connection with the dispute&period;<&sol;em><&sol;p>&NewLine;<p><em>&CenterDot; An order restraining the 1st&comma; 2nd&comma; 3rd&comma; 4th&comma; 5th&comma; 6th and 7th respondents from investigating the sale of the property located at E18&comma; <a href&equals;"https&colon;&sol;&sol;www&period;premiumtimesng&period;com&sol;">Citadel Estate<&sol;a>&comma; Ogombo Road&comma; Lekki&comma; Lagos&period;<&sol;em><&sol;p>&NewLine;<p><em>&CenterDot; An order directing a refund of the N500&comma;000 allegedly extorted from her and restraining the respondents from selling&comma; investigating or interfering with the property purchased in her daughter’s name&period;<&sol;em><&sol;p>&NewLine;<p><em>&CenterDot; An order compelling the 5th and 6th respondents &lpar;CSP Bolugi and Inspector Abayomi respectively&rpar; to refund to her the sum of N500&comma;000 illegally collected from her on 7 January 2025&period;<&sol;em><&sol;p>&NewLine;<p><em>&CenterDot; Award N50 million in damages against the police officers and Mr&period; Adesiyan&comma; the estranged husband&comma; for alleged unlawful arrest&comma; detention and abuse of power&period;<&sol;em><&sol;p>&NewLine;<p><em>&CenterDot; A declaration that the police lack constitutional authority to intervene in matrimonial disputes or engage in debt recovery arising from civil transactions&period;<&sol;em><&sol;p>&NewLine;<p>&nbsp&semi;<&sol;p>&NewLine;
